IQVIA Consent Terms of Use


1. Terms.

IQVIA operates this microsite of the IQVIA Consent Management (hereinafter IQVIA Consent) to provide the tools and procedures for the collection, registration and processing of information, with or without personal data, of healthcare professionals, both by IQVIA and by third parties belonging to the medical-pharmaceutical sector that make use of the services of IQVIA Consent or contract with IQVIA to carry out, on behalf of said third parties, the collection, registration and treatment of information related to healthcare professionals.

Likewise, IQVIA Consent offers the procedures for obtaining the permits and consents of the healthcare professionals from whom information is collected, with or without personal data, for the different actions, treatments and assignments carried out by the holders or responsible parties of information collected from healthcare professionals.

Your access and use of this microsite are subject to the following terms and conditions and constitutes acceptance of these terms (“Terms of Use”). IQVIA reserves the right to modify these Terms of Use at any time without giving you prior notice. Your use of the Web site following any such modification constitutes your agreement to follow and be bound by the Terms of Use as modified.

2. License and Access.

Your use of IQVIA Consent and the information, writings, images and/or other works that you see, hear or otherwise experience on the microsite (singly or collectively, the "Content") must be for your internal business purposes and be lawful. In no case, may users: (i) use the Content to advertise or market products and services and / or for the commission of illicit actions or in a manner contrary to current legislation, morals, good customs and public order, for the purposes of damaging the rights of IQVIA and / or third parties, or that may harm, damage or prevent by any means, access to them, to the detriment of IQVIA and / or third parties; and (ii) use any type of computer virus, code, software, computer program, computer or telecommunications equipment that may cause damage or unauthorized alterations to the contents, programs or systems accessible through the contents provided in IQVIA Consent or in information systems, files and computer equipment of users.

3. Disclaimer of Warranties

IQVIA is not responsible for the use of the information collected by the third parties of the medical-pharmaceutical sector.

IQVIA makes no express or implied warranties, representations or endorsements whatsoever with respect to the microsite or the content. IQVIA expressly disclaims all warranties of any kind, express, implied, statutory or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a purpose, title and non-infringement, with regard to the microsite, the content, and any product or service furnished or to be furnished via the web site. IQVIA does not warrant that the functions performed by the microsite will be uninterrupted, timely, secure or error-free, or that defects in the microsite will be corrected. IQVIA does not warrant the accuracy or completeness of the content, or that any errors in the content will be corrected. the microsite and the content are provided on an "as is" and "as available" basis.

4. Limitation of Liability

In no event will IQVIA be liable for any damages whatsoever, including, but not limited to any direct, incidental, consequential, special, exemplary or other indirect damages arising out of (i) the use of or inability to use the microsite or the content, (ii) any transaction conducted through or facilitated by the microsite; (iii) any claim attributable to errors, omissions, or other inaccuracies in the microsite, the service and/or the content, (iv) unauthorized access to or alteration of your transmissions or data, or (v) any other matter relating to the microsite, or the content, even if IQVIA has been advised of the possibility of such damages. If you are dissatisfied with the microsite, the content, or with the terms of use, your sole and exclusive remedy is to discontinue using the microsite.

Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In such states, IQVIA’s liability is limited and warranties are excluded to the greatest extent permitted by law, but shall, in no event, exceed $100.00.

5. Copyright.

IQVIA, its suppliers or the original creator of the Content own all copyrights to Content on the microsite and all other intellectual property rights related to the microsite. You may not, without IQVIA’s permission, "mirror" any Content contained on the microsite or any other server. Except as specified above, nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any trademark, patent, copyright, or any other intellectual property right of IQVIA or any third party.

6. Trademarks

The trademarks, logos, service marks, brand identities, title, characters, trade names, graphics, designs, and other properties (collectively the "Trademarks") displayed on the IQVIA Consent microsite are protected intellectual properties that are registered and unregistered trademarks of IQVIA, its affiliates and others. Nothing contained on the IQVIA microsite should be construed as granting, by implication, or otherwise, any license or right to use any Trademark displayed on this microsite without the written permission of IQVIA or such third party that may own the Trademark displayed on IQVIA’s microsite. Your misuse of the Trademarks displayed on IQVIA’s microsite, or any other Content, except as provided herein, is strictly prohibited.

8. Digital Millennium Copyright Act

IQVIA is committed to complying with U.S. copyright law and to responding to claims of copyright infringement. IQVIA will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c) (“DMCA”).
